1. Scope of Application

These General Terms and Conditions (T&C) apply to all contracts between the client and Kilian Boraki, freelance translator and project manager, operating under the name "Kaiwords Translation Agency", concerning the provision of translation, interpreting, and localization services as well as other language-related services.

Deviating conditions of the client do not apply unless they are expressly acknowledged in writing.

2. Conclusion of Contract

2.1

A contract is concluded when the client accepts a written or electronic offer from Kaiwords Translation Agency and the acceptance is confirmed in writing or by email by the agency.

2.2

The basis for the offer are the contents, texts, requirements, and any special wishes transmitted by the client. Changes to the scope or contents after conclusion of the contract may result in price and delivery time adjustments.

2.3

Kaiwords Translation Agency reserves the right to reject orders without stating reasons – particularly in the case of texts with illegal, extremist, or immoral content as well as unreasonable time pressure.

3. Client's Obligations to Cooperate

3.1

The client is obliged to provide Kaiwords Translation Agency with all information, documents, and any reference materials required for the proper execution of the order in a timely and complete manner.

3.2

In the case of specific terminology wishes, technical terms, or existing glossaries, the client is obliged to provide these in advance. Otherwise, the translation will be prepared according to generally recognized standards and usual technical terms.

3.3

For interpreting assignments, the client is obliged to provide schedules, topic priorities, names of participants, and any preparatory speeches and presentations in advance.

3.4

If the client does not fulfill or delays fulfilling their obligations to cooperate, the delivery period may be extended accordingly. Any additional costs or delays arising from this shall be borne by the client.

4. Execution by Third Parties

4.1

Kaiwords Translation Agency is entitled to entrust qualified freelance translators, interpreters, or specialists with the execution of orders. All employees are bound to confidentiality.

4.2

Direct contact between the client and the commissioned third parties only takes place after prior approval by Kaiwords Translation Agency.

5. Scope of Services

5.1

The services of Kaiwords Translation Agency include written translations, certified translations, interpreting services (on-site or remote) as well as localization projects and related language-related activities.

5.2

Unless otherwise agreed in writing, translations are prepared according to the generally recognized quality standard of the respective language combination – factually correct, stylistically appropriate, and taking into account the purpose of the translation.

5.3

Special services such as layout adjustments, certified translations, express translations, proofreading, text entry, transcriptions, terminology creation, or technical formatting are only included to the extent of the respective offer.

5.4

For interpreting assignments, the client is obliged to provide all relevant information, speeches, schedules, and working conditions in a timely manner. The success of the assignment depends significantly on these preparations.

6. Delivery Periods

6.1

Delivery periods are only binding if they have been agreed in writing and confirmed by Kaiwords Translation Agency.

6.2

Delays due to force majeure (e.g., illness, failure of external translators, technical disruptions) extend the delivery period appropriately.

6.3

Delivery is made in the agreed form – usually digitally by email or via a secure cloud link. Delivery is considered to have been made with documented dispatch.

7. Remuneration & Payment

7.1

Remuneration depends on language combination, text volume, level of difficulty, formatting effort, and desired delivery date. The price stated in the offer applies.

7.2

Prices are understood – unless otherwise agreed – as net and in euros.

7.3

Invoices are due immediately upon receipt and without deduction, but no later than within 14 days.

7.4

In case of payment default, Kaiwords Translation Agency is entitled to charge default interest at the statutory rate (§ 288 BGB). Reminder costs may be charged additionally.

8. Cancellation by the Client

8.1

Cancellation by the client is possible at any time but must be made in writing.

8.2

In case of cancellation, services already rendered will be invoiced to the client proportionally. Additionally, depending on the processing status, the following cancellation fees may apply:

  • up to 24 hours after order placement: free of charge
  • after start of processing: 50% of the order value
  • in case of short-term cancellation of an interpreting assignment (<48h): 100% of the fee

8.3

Partial services already created will be transmitted to the client upon request, but without claim to completion or correction.

9. Acceptance & Complaints

9.1

The client is obliged to check the delivered service immediately after receipt.

9.2

Obvious defects must be reported in writing no later than within 7 calendar days after delivery. If no feedback is received, the service is considered accepted.

9.3

In case of justified defects, Kaiwords Translation Agency will be granted an appropriate period for rectification. Two rectification attempts are included.

9.4

Stylistic preferences or terminological preferences do not constitute defects, provided that no terminological specifications were documented in advance.

This data is used exclusively for the purpose of processing your inquiry and for carrying out pre-contractual measures or for contract fulfillment.

4. Disclosure of Data

Disclosure of your data to third parties only takes place if this is necessary for processing your order (e.g., to freelance translators or tax advisors) or if you have expressly consented.

All external service providers are contractually obliged to comply with data protection requirements.

5. Storage Period

I store your personal data only as long as this is necessary for the fulfillment of the purposes or legal retention obligations exist. After the purpose ceases to apply or these periods expire, the data will be deleted.

6. Your Rights

You have the right at any time to:

  • Information about your stored data
  • Correction of incorrect data
  • Deletion of your data (provided no legal obligations oppose this)
  • Restriction of processing
  • Objection to processing

7. SSL/TLS Encryption

For security reasons and to protect the transmission of confidential content, this website uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser begins with "https://".

8. Server Log Files

When visiting this website, information is automatically collected by the web server:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of server request
  • IP address

This data cannot be assigned to specific persons and serves exclusively for technical security and improvement of the offer.

9. Cookies

This website uses cookies in part to improve user-friendliness. These are small text files that are stored on your device. Most of the cookies used are "session cookies", which are automatically deleted after the end of your visit. 10. Order Processing

If external service providers receive access to personal data in the context of order processing, this only happens on the basis of a contract in accordance with Art. 28 GDPR.
